BUSINESS PARTNERSHIP PROGRAM

TERMS & CONDITIONS + PRIVACY POLICY

Last updated: December 2024

TERMS & CONDITIONS

1. Introduction

These Terms & Conditions govern participation in the Expats Living Abroad Business Partnership Program, also referred to as the Expat Partner Business Network or Service Provider Partnership Program (“Program”).
By purchasing any of our subscription packages (Silver, Gold, or Elite) or participating in any related activities, you (“Expat Partner,” “Service Provider,” “Partner,” or “you”) agree to be bound by these Terms.

ELA (“we,” “our,” “us”) provides visibility, digital features, community access, and client referrals designed to support businesses within the global expat ecosystem.
ELA is not a social media marketing agency, PR agency, advertising agency, or professional film-production service.

2. Scope of Services

ELA provides varying levels of visibility and referral benefits depending on the purchased package. These may include:

  • Priority referrals

  • Digital features on ELA platforms (website, blog, email list, YouTube, podcast, social media, etc.)

  • Custom promotional content

  • Community group access

  • Networking and VIP invitations

  • Marketing campaigns

  • Business spotlights

All services are provided at ELA’s discretion, following our internal editorial standards, creative direction, and production capabilities.

3. Creative Control & Editorial Authority

To maintain consistent quality across the ELA ecosystem, ELA retains full editorial and creative control over:

  • Digital content creation

  • Video production

  • Blog features and written content

  • Email campaigns

  • Social media posts

  • Podcast or YouTube guest features

  • Graphic and branding elements

This means:

  1. ELA is not obligated to edit, modify, recreate, or re-produce content at the request of the Partner unless ELA chooses to do so.

  2. Content creation timelines and formats are determined solely by ELA.

  3. Partners may provide general brand guidelines, but ELA reserves the right to prioritize its own creative standards.

Partners may not demand, dictate, or attempt to control production processes, posting schedules, copywriting style, or digital strategy.

4. Accuracy, Typographical Errors & Platform-Generated Text

ELA maintains a high standard of professionalism and accuracy in all content we produce. That said, minor typographical or formatting variances may occur within digital materials. These do not constitute grounds for refunds, cancellations, disputes, or cease-and-desist demands.

In addition, many digital platforms automatically generate certain elements that are outside of ELA’s control, including but not limited to:

  • Auto-generated captions on YouTube, Instagram, TikTok, Facebook Reels, and other short-form video platforms

  • Auto-corrected or platform-formatted text overlays

  • Automatically transcribed subtitles

  • System-generated spacing, line breaks, hashtags, display text, or visual compression artifacts

  • AI-assisted transcription errors produced by third-party platforms

As these elements are produced by external systems and not by ELA, ELA cannot guarantee accuracy nor be held responsible for platform-generated errors or misinterpretations.

If an Expat Partner notices a typographical issue within ELA-created text (excluding automatic platform-generated content), we welcome respectful notification. ELA may choose—at its discretion—to correct or update the content when feasible and when aligned with editorial standards.
However, such corrections are not obligated and do not impact the validity or fulfillment of the contracted service package.

5. Intellectual Property Rights

5.1 ELA-Created Content

All content created by ELA for or relating to your business—including but not limited to videos, graphics, text, marketing assets, photography, blog posts, interviews, and recorded media—remains the sole property of ELA.

ELA grants Partners a non-exclusive, non-transferable license to share or repost the content for self-promotion during the subscription period.

Partners do not own the content and may not:

  • Demand edits or removal

  • Restrict ELA’s right to publish

  • Issue takedown requests

  • Attempt to control usage or distribution

  • Repurpose content without ELA’s written permission

5.2 Partner-Owned Content

Any materials provided by the Partner remain the Partner’s property.
However, by participating in the Program, the Partner grants ELA a perpetual, royalty-free license to use provided materials for marketing and promotional purposes.

6. No Cease & Desist Claims for Contracted Deliverables

Because the Program involves visibility and exposure services, once ELA creates and publishes content as part of your subscription:

  • You cannot issue a cease & desist order to halt use of those materials.

  • You cannot demand permanent removal of content unless there is a legal reason (e.g., defamation, privacy breach).

  • Discomfort with creative style is not grounds for removal.

ELA may choose to remove content voluntarily at its discretion, but is not obligated.

7. Referrals & Client Volume

Referral numbers stated in package descriptions (e.g., up to 36 per year for Elite) represent the maximum potential volume, not a guaranteed minimum.

ELA does not guarantee:

  • Specific outcomes

  • Booked clients

  • Conversion rates

  • Revenue increases

  • Engagement levels

ELA provides visibility opportunities, not guaranteed sales.

8. Conduct Expectations

Partners must maintain professional and respectful communication.
ELA reserves the right to:

  • Decline service

  • Pause collaboration

  • Terminate a partnership without refund

…if a Partner engages in:

  • Harassment

  • Abusive communication

  • Repeated unreasonable demands

  • Defamation

  • Attempts to control or dictate ELA’s creative processes

9. Refunds & Cancellations

All Program fees are non-refundable, including:

  • Digital features

  • Visibility benefits

  • Custom marketing content

  • Sale or discounted pricing

  • Unused referral opportunities

  • Early termination by the Partner

Refunds are not issued due to dissatisfaction with creative style or content format.

10. Limitation of Liability

ELA is not liable for:

  • Loss of business

  • Loss of income

  • Missed opportunities

  • Negative reviews or engagement

  • Errors in third-party platforms

  • Partner dissatisfaction with creative direction

Total liability, if ever applicable, is limited to the amount the Partner paid for their subscription.

11. Termination

ELA may terminate a Partner's subscription if the Partner:

  • Violates these Terms

  • Behaves in a manner harmful to the ELA community

  • Attempts to control or disrupt ELA’s editorial functions

No refunds will be provided.
